§ 549.01. Definitions.

  • As used in this Article, unless the context otherwise requires:

    Child means any person under the age of 18.

    Child care facility means a day care center or home which provides regular care to any number of children.

    Child safety zone means child care facilities, parks, playgrounds and schools. A child safety zone shall also include public libraries, amusement arcades, video arcades, indoor and outdoor amusement centers, amusement parks, public or commercial and semi-private swimming pools, crisis centers or shelters, skate parks or rinks, public or private youth centers, movie theaters, bowling alleys, and scouting facilities.

    Database means the West Virginia State Police's Sex Offender Registry as established by W. Va. Code § 15-12.

    Loiter means standing, sitting idly, whether or not the person is in a vehicle or remaining in or around an area.

    Park or playground means one of the following:

    (1)

    Any land, including improvements to the land that is administered, operated or managed by the City of Hurricane or any other public entity for the use of the general public as a recreational area.

    (2)

    Recreational areas, which includes, but is not limited to, conservation areas, jogging trails, hiking trails, bicycle trails, recreational centers, water parks, swimming pools, soccer fields, baseball fields or football fields.

    School means a private or public pre-school, private or public elementary school or private or public secondary school.

    Sex offender means an individual who has been convicted of or placed on deferred adjudication for a sexual offense involving a person under 18 years of age for which the individual is required to register as a sex offender under W. Va. Code § 15-12.
