§ 935.02. Sanitary Stormwater Board—Created; powers and duties; members; term.

  • There is hereby created in and for the City, a combined Sanitary Stormwater Board (also referred to in this Article as the "Sanitary Stormwater Board" or the "Board"), which shall be charged with the construction, custody, supervision, control, administration, operation and maintenance of the municipal sewage and stormwater system, all as permitted and provided by W. Va. Code, § 16-13-1 et seq. The combined Sanitary Stormwater Board shall be composed of the Mayor and four persons appointed by Council, one of whom shall be a registered professional engineer; provided, that when no City sewer or stormwater collection is under construction, a registered professional engineer need not be a member of the Board. Members of the Board shall serve for staggered terms of three years and/or until their respective successors have been duly appointed and qualified. Vacancies other than those due to expiration of term shall be filled for the unexpired term only.
