 Article 115. COUNCIL

  § 115.02. Meetings; regular, special and executive.

  • (a)

    Council shall meet in regular session of the first Monday of each month at 6:30 p.m. in the Council Chambers in the City Building. When the regular meeting is postponed due to a holiday or other reason, public notice shall be given and the meeting shall be held on the Tuesday after the holiday.

    (b)

    A notice shall be posted and maintained by the Recorder, or designated person, at the front door or bulletin board of the City Building, stating the date, time and place fixed and entered of record by Council for the holding of regularly scheduled meetings. In addition, a copy of the agenda for each regularly scheduled meeting shall be posted at the same location by the Recorder, or designated person, not less than 72 hours before such regular meeting is to be held.

    (c)

    If a particular regularly scheduled meeting is canceled or postponed, a notice of such cancellation or postponement shall be posted at the same location as soon as feasible after such cancellation or postponement has been determined.

    (d)

    Special meetings of Council shall be held when called by the Mayor or four members thereof. Except in the event of an emergency requiring immediate official action, the time, place and purpose of all special meetings shall be published in the official recognized newspaper of general circulation in the City. No business, other than that stated in the newspaper announcement, shall be considered at such meeting.

    (e)

    In addition, a notice shall be posted by the Recorder, or designated person, at the front door or bulletin board of the City Hall not less that 72 hours before a specially scheduled meeting is to be held, stating the date, time, place and purpose for which such special meeting shall be held. If the special meeting is canceled, a notice of such cancellation shall be posted at the same location as soon as feasible after such cancellation has been determined.

    (f)

    An executive session may be held during a regular, special or emergency meeting, but only in compliance with W. Va. Code, § 6-9A-4. No decision shall be made in such executive session.
