§ 117.06. Applicability of ordinances to acts and omissions beyond city limits.

  • (a)

    Wherever in these Codified Ordinances or in any ordinance or resolution of Council any act is prohibited or is declared to be unlawful or an offense or misdemeanor, or the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or a misdemeanor, and no specific place or geographical area is specified with respect to such act, then the doing of such prohibited act or the failure to do such required act shall be unlawful both within the corporate limits of the City and within the unincorporated areas surrounding the City from such distance beyond the corporate limits as may be within the extraterritorial jurisdiction of the City as provided in the Code of West Virginia.

    (b)

    Wherever in these Codified Ordinances or in any other ordinance or resolution of Council any act is prohibited or is declared to be unlawful or an offense or misdemeanor or the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or misdemeanor within any given distance beyond the corporate limits of the City, pursuant to any pertinent provision of State law, any incorporated area within such distance beyond the corporate limits of the City is excluded.
