§ 129.11. Indebtedness to city; delinquent payments.

  • The City Treasurer, upon application for and prior to paying out money to any person entitled thereto, may, in the exercise of sound discretion, first ascertain whether such person is delinquent in the payment of any City tax or is otherwise indebted to the City, insofar as such indebtedness, if any, may appear on the City's records. Upon so ascertaining that such person is in fact indebted to the City, the City Treasurer shall then take proper action pursuant to the established administrative and accounting procedures to apply all or such part of the amount to which such person is entitled to receive from the City to the full or partial payment, as the case may be, of his debt to the City; and if the amount such person is entitled to receive from the City exceeds the amount of his indebtedness to the City, the Treasurer shall then pay out to such person the amount of such excess, and, in either case the Treasurer shall give to such person a memorandum of the entire transaction.
