§ 345.04. Headlights on motor vehicles and motorcycles.

  • (a)

    Every motor vehicle other than a motorcycle, motor-driven cycle or moped shall be equipped with at least two headlamps with at least one on each side of the front of the motor vehicle, which headlamps shall comply with the requirements and limitations set forth in this section.

    (b)

    Every motorcycle, motor-driven cycle and moped shall be equipped with at least one and not more than two headlamps which shall comply with the requirements and limitations of this section.

    (c)

    Every headlamp upon every motor vehicle, including every motorcycle, motor-driven cycle and moped, shall be located at a height measured from the center of the headlamp of not more than 54 inches nor less than 24 inches to be measured as set forth in Section 345.03. (W. Va. Code, § 17C-15-4)

    (d)

    Any person violating the provisions of this section is guilty of a misdemeanor and, upon conviction thereof, shall be fined not more than $100.00 plus the costs imposed by the Municipal Court. (W. Va. Code, § 17C-15-6)
