§ 1123.17. Grass, weeds and vegetation.

  • (a)

    No owner, occupant or person in charge of any premises shall allow or permit thereon any growth of weeds to the height of more than ten inches, nor shall any person allow or permit the growth of any weeds or grass upon any part of any sidewalk abutting such premises.

    (b)

    All premises shall be maintained by the owners, occupants and persons in charge thereof free of vegetation which affords a breeding place for insects, reptiles or rodents; and upon all premises not devoted to agricultural uses, the grass thereon shall be kept trimmed to a height of not more than ten inches.

    (c)

    Grass, weeds and vegetation, when cut down, shall be removed from the premises and disposed of in such manner as not to create a nuisance.

    (d)

    One notice from the City's Building Inspector will be issued per calendar year to any owner that violates Section 1123.17. Upon an owner receiving the notice, all grass exceeding ten inches in height must be cut on the owner's property within 72 hours. Failure to comply will result in the City cutting the grass and other necessary work to abate the high grass, weeds, and trash on the premises at the violator's expense. A lien will be recorded for City services rendered on the owner's property in the County Clerk's office. Any subsequent violation observed by the City's Building Inspector, the City shall have the right to cut the grass and abate the violations to comply with the provisions of Section 1123.17 immediately upon referral and without additional notice by the City's Building Inspector. The property owner will be subject to additional liens and fees for this work. The City's Building Inspector reserves the right to notify the property owner to appear before Municipal Court as he deems appropriate for grass, weed and trash violations.

    (e)

    At the City's Building Inspector's discretion, the Inspector reserves the right to place a Municipal Court summons on the residence or business, in addition to the recording of the lien referenced above for the City's services. The City's Municipal Court has the authority to impose a fee of $100.00 for the first violation, $250.00 for the second violation and $500.00 for the third and subsequent violations. All court fees are applicable with regard to these hearings in relation to grass, weed, and trash under Section 1123.17.
