§ 1333.02. Zoning of annexed areas to provide for pre-determination of the zoning class prior to annexation.

  • Unzoned areas to be annexed into the City shall be classified by the City prior to the annexation according to the use of the area. If the area to be annexed is other than R-1 single-family residential, the application shall be submitted to the Municipal Planning Commission for review, and a public hearing will be held, and the Municipal Planning Commission's recommendation shall be forwarded to City Council for final approval of the zoning classification. If any party desiring to be annexed does not agree or concur with the decision as to the zoning classification of the area to be annexed, the annexation applicant may withdraw his petition and the matter shall proceed no further.
